Overview
Welcome to Harmonex. The terms “Harmonex,” “we,” “us,” and “our” refer to Harmonex LLC. Harmonex operates this website and online store, including all related information, content, features, tools, products, and services offered through it (collectively, the “Services”). The Services are powered by Shopify, which enables us to provide our online store to you.
These Terms of Service (“Terms”), together with the policies referenced in them, describe your rights and responsibilities when you access or use the Services or purchase products from Harmonex.
Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, accessing, interacting with, or using the Services, or by placing an order, you agree to be bound by these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, you must not use the Services.
Section 1 — Eligibility, Access, and Accounts
You must be at least 18 years old and have reached the age of majority in your jurisdiction to place an order or create an account through the Services. By using the Services, you represent that you satisfy these requirements.
You may be asked to provide information such as your name, email address, billing information, payment information, and shipping address. You represent and warrant that the information you provide is accurate, current, and complete and that you have the right to provide it.
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity conducted through your account. You must notify us promptly if you believe that your account or payment information has been accessed or used without authorization. You may not transfer, sell, assign, or license your account to another person.
We may refuse service, suspend accounts, or restrict access to the Services when reasonably necessary to protect Harmonex, our customers, Shopify, or other parties, or when we believe these Terms or applicable law have been violated.
Section 2 — Products and Product Information
We make reasonable efforts to describe and display our products accurately. However, colors, packaging, label design, and product appearance may vary from what appears on your device or from images displayed through the Services. Product packaging may also change before website images are updated.
Product descriptions, ingredients, Supplement Facts, directions, warnings, pricing, and availability are subject to change. Always read the physical product label and packaging before use. If you have questions about a product or notice a material discrepancy, contact us before using it.
We do not guarantee that a product’s appearance, taste, packaging, or results will meet your personal expectations. We may discontinue products, modify product offerings, or limit the quantities available to any person, household, geographic region, or jurisdiction.
Section 3 — Dietary Supplement and Health Disclaimer
Certain products offered through the Services are dietary supplements. Dietary supplements are not drugs. Statements made on or through the Services regarding dietary supplements have not been evaluated by the U.S. Food and Drug Administration. Products offered through the Services are not intended to diagnose, treat, cure, or prevent any disease.
Information provided through the Services is for general informational and educational purposes only. It is not medical advice and is not a substitute for advice, diagnosis, or treatment from a licensed healthcare professional.
Before using any dietary supplement, you should review the complete ingredient list, allergen information, directions, and warnings. Consult a qualified healthcare professional before use if you are pregnant or nursing, taking medication, planning a medical procedure, have an allergy or medical condition, or have questions about whether a product is appropriate for you.
Use products only as directed on their labels. Do not exceed the recommended amount. Keep products out of reach of children. Stop use and seek appropriate medical advice if you experience an adverse reaction. If you believe you are experiencing a medical emergency, contact emergency services immediately.
Individual responses to dietary supplements vary. Harmonex does not promise or guarantee any particular health, wellness, or performance result. To the fullest extent permitted by law, Harmonex is not responsible for harm caused by use that is inconsistent with product labeling, warnings, or these Terms.
Section 4 — Orders and Acceptance
When you submit an order, you are making an offer to purchase the selected products. An order confirmation acknowledges that we received your order but does not necessarily constitute acceptance. Your order is accepted when we confirm acceptance, capture payment, or begin fulfillment, whichever occurs first.
We may accept, reject, limit, or cancel an order for legitimate reasons, including product unavailability, pricing or description errors, suspected fraud, payment issues, shipping restrictions, prohibited resale, or violation of these Terms. If we cancel an order after charging you, we will refund the canceled amount to the original payment method.
Please review your order carefully before submitting it. We may be unable to change or cancel an order after processing or fulfillment has begun.
Purchases through the Services are intended for personal or household use unless Harmonex has expressly authorized a separate commercial or wholesale arrangement in writing. You may not purchase products for unauthorized resale, diversion, or export.
Refund requests are governed exclusively by our 30-Day Refund Policy.
Section 5 — Prices, Billing, Taxes, and Promotions
Prices, discounts, and promotions may change without notice. The price charged will be the price shown when you submit your order, subject to correction of obvious errors. Unless expressly stated otherwise, displayed prices do not include shipping, handling, taxes, customs duties, import charges, or similar governmental charges.
You agree to provide accurate and complete billing, payment, and account information and to keep that information current. You represent that you are authorized to use the payment method submitted and that charges incurred through it will be honored.
Promotional offers and discount codes may be subject to separate terms, including expiration dates, product limitations, minimum purchases, and customer eligibility requirements. Unless expressly stated otherwise:

Discount codes have no cash value;

Only one discount code may be used per order;

Discounts cannot be applied retroactively;

Discount codes may not be sold, transferred, reproduced, or distributed through unauthorized channels; and

We may reject or cancel discounts obtained or used fraudulently, unlawfully, or contrary to their stated terms.
If separate promotion terms conflict with these Terms, the promotion terms will govern for that promotion.
Section 6 — Subscriptions and Recurring Charges
Certain products may be offered as recurring subscriptions. When you purchase a subscription, you expressly authorize Harmonex and its payment service providers to charge your selected payment method automatically for the recurring amount and delivery frequency displayed at checkout, together with applicable shipping charges and taxes, until the subscription ends or you cancel it.
Subscription pricing, discounts, delivery frequency, and any minimum or fixed term will be disclosed before purchase. We may change future subscription pricing or other material subscription terms by providing advance notice when required by applicable law. You may cancel before a change takes effect.
You may manage or cancel a subscription using the link provided in your account, order confirmation, or subscription emails, or by contacting info@liveharmonex.com. Cancellation applies to future recurring charges and does not automatically cancel or refund an order that has already been processed.
Requesting a refund does not automatically cancel a subscription. Subscription changes and cancellations are governed by our Purchase Options Cancellation Policy, which is incorporated into these Terms.
If a recurring payment fails or a product is unavailable, we may retry the payment, delay or skip the applicable delivery, pause the subscription, or cancel it, subject to the settings disclosed through the subscription service and applicable law.
Section 7 — Shipping and Delivery
Shipping methods, estimated delivery times, charges, and other shipping conditions are described in our Shipping Policy, which is incorporated into these Terms.
Delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs authorities, incorrect or incomplete addresses, weather, service disruptions, or events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. We cannot guarantee that an address can be changed after an order enters processing. For international orders, you are responsible for customs duties, import taxes, brokerage fees, and compliance with local import requirements unless we expressly state otherwise.
Except where applicable law provides otherwise, title and risk of loss pass to you upon confirmed delivery to the address provided with the order. Contact us promptly if tracking shows delivery but you did not receive the package, or if the package arrives damaged or incorrect.
Section 8 — Refunds and No Physical Returns
Eligible purchases made directly through liveharmonex.com are covered by our 30-Day Refund Policy.
For health, hygiene, and safety reasons, Harmonex does not accept physical product returns. Do not mail products to Harmonex unless we specifically instruct you to do so. Products purchased from Amazon, Walmart, another retailer, or a third-party marketplace are governed by that seller’s refund policy.
Nothing in this section limits any refund, replacement, cancellation, or other consumer right that cannot legally be waived.
Section 9 — Intellectual Property
The Services—including trademarks, logos, product names, text, graphics, photographs, videos, audio, page designs, software, and the selection and arrangement of content—are owned by or licensed to Harmonex, its affiliates, or its licensors and are protected by United States and international intellectual property laws.
These Terms grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal and non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, or commercially exploit any portion of the Services without our prior written permission, except as permitted by law.
Harmonex names, logos, product names, designs, and slogans are trademarks of Harmonex or its licensors. Shopify’s names, logos, product names, designs, and slogans are trademarks of Shopify. Nothing in these Terms grants you any license to use these marks without the applicable owner’s prior written permission.
All rights not expressly granted are reserved.
Section 10 — Optional and Third-Party Tools
The Services may provide access to tools, applications, payment services, integrations, or other functionality operated by third parties. We may not monitor or control these tools.
Access to third-party tools is provided “as is” and “as available,” without warranties, representations, or endorsements from Harmonex. Your use of them is at your own risk and may be subject to separate third-party terms and privacy policies. You are responsible for reviewing those terms before using the tools.
We may introduce new tools, features, or resources through the Services. Unless stated otherwise, they will form part of the Services and will be subject to these Terms.
Section 11 — Third-Party Links and Services
The Services may contain links to or embedded materials from third-party websites. We do not control and are not responsible for evaluating the accuracy, content, security, practices, products, or services of third parties.
If you access a third-party website or purchase products or services from a third party, you do so at your own discretion and subject to that third party’s terms and policies. Questions or complaints concerning third-party products or services should be directed to the applicable third party.
Section 12 — Affiliates, Influencers, and Other Third-Party Statements
Harmonex may work with independent affiliates, ambassadors, influencers, reviewers, or other third parties who promote our products or provide referral links or discount codes. These parties are not employees, healthcare providers, or authorized agents of Harmonex and do not have authority to make promises, warranties, medical claims, or representations on our behalf.
Unless a statement appears on an official Harmonex Service or in materials expressly approved by Harmonex, statements made by an affiliate, influencer, reviewer, customer, or other third party reflect that person’s own views and should not be treated as medical advice, a product guarantee, or an authorized Harmonex statement.
Some third parties may receive commissions, free products, discounts, or other compensation in connection with their content. They are responsible for making legally required disclosures. Nothing in this section limits rights or remedies that cannot be waived under applicable law.
Section 13 — Relationship with Shopify
Harmonex is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with Harmonex. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Harmonex, including any injury, damage, or loss resulting from purchased products or services. To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with Harmonex.
Section 14 — Privacy
Personal information collected through the Services is handled as described in our Privacy Policy. Certain personal information may also be processed under Shopify’s Privacy Policy.
Because Shopify hosts the Services, Shopify collects and processes certain information about your access to and use of the Services in order to provide and improve them. Information submitted through the Services may be transmitted to Shopify and to service providers located in countries other than the country in which you reside. Review our Privacy Policy for more information about how Harmonex, Shopify, and our service providers process personal information.
Section 15 — Feedback, Reviews, and Submissions
If you submit, upload, post, email, or otherwise provide ideas, suggestions, feedback, reviews, photographs, videos, proposals, or other content (“Feedback”), you grant Harmonex a non-exclusive, perpetual, worldwide, transferable, sublicensable, royalty-free license to use, reproduce, modify, publish, translate, distribute, display, and otherwise use that Feedback in any medium for lawful business purposes, including operating, improving, and promoting the Services.
You represent and warrant that:

You own or have obtained all rights necessary to provide the Feedback and grant this license;

Your Feedback is truthful and is not misleading;

You have disclosed any compensation, incentive, discount, or free product received in connection with the Feedback; and

Your Feedback does not violate any law, contract, intellectual property right, privacy right, publicity right, or other right of any person.
We are not obligated to keep Feedback confidential, pay compensation for it, publish it, or respond to it. We may monitor, edit, refuse, or remove Feedback that we believe violates these Terms or is unlawful, misleading, offensive, defamatory, obscene, or otherwise objectionable.
You may not submit Feedback using a false identity, misrepresent its origin, or include malware or harmful code. You remain solely responsible for your Feedback.
Section 16 — Errors, Inaccuracies, and Omissions
The Services may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, ingredients, pricing, promotions, offers, shipping charges, delivery estimates, or availability.
We may correct errors, update information, or cancel affected orders at any time, including after an order is submitted. If we cancel an order because of an error after payment has been collected, we will refund the canceled amount to the original payment method.
Section 17 — Prohibited Uses
You may use the Services only for lawful purposes. You may not, directly or indirectly:

Use the Services in violation of any international, federal, state, provincial, or local law or regulation;

Infringe or violate the intellectual property, privacy, publicity, contractual, or other rights of Harmonex or another person;

Submit false, fraudulent, deceptive, defamatory, abusive, threatening, obscene, or misleading information;

Impersonate another person or misrepresent your identity or affiliation;

Engage in unauthorized resale, diversion, export, sanctions evasion, or fraudulent purchasing activity;

Send spam, phishing messages, chain letters, malware, viruses, or other harmful material;

Collect, scrape, harvest, or track personal information or site content without authorization;

Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without permission;

Bypass or interfere with security, access controls, rate limits, robot exclusions, or other protective measures;

Use automated systems, bots, spiders, data-extraction tools, or artificial-intelligence agents to access or interact with the Services except as expressly permitted by us; or
-
Engage in conduct that restricts another person’s use of the Services or that may harm Harmonex, Shopify, our customers, or other parties.
We may suspend, restrict, or terminate access if we reasonably believe this section has been violated.
Section 18 — Automated Agents
This section applies if you deploy or permit software or a service that acts autonomously or semi-autonomously on behalf of a person or entity (an “Agent”) to access or interact with the Services.
An Agent may access the Services only when permitted by Harmonex and when it accurately identifies itself. An Agent must not conceal that it is automated, mimic human behavior for the purpose of evading controls, complete or circumvent CAPTCHAs, misrepresent its identity, or bypass measures intended to block, limit, or manage automated access.
We may use technical or other measures to restrict whether and how Agents access or interact with the Services. An Agent must stop accessing the Services if requested by Harmonex.
Section 19 — Electronic Communications
By using the Services or providing contact information in connection with an order or account, you consent to receive transactional communications electronically, including order confirmations, shipping notices, subscription notices, account notices, safety communications, and policy updates.
Electronic communications satisfy any legal requirement that such communications be in writing, to the extent permitted by law. You are responsible for maintaining a current email address and for retaining copies of communications for your records.
Transactional communications are separate from promotional marketing. Where required, marketing emails or text messages will be sent only with the applicable consent, and you may unsubscribe from marketing without affecting necessary transactional communications.
Section 20 — Suspension and Termination
We may suspend or terminate your account or access to all or part of the Services if you violate these Terms, misuse the Services, engage in fraud or unlawful conduct, or create a risk of harm or liability to Harmonex, Shopify, our customers, or another party.
You remain responsible for amounts properly incurred before termination. Termination does not automatically cancel or refund an order already accepted or processed, and subscriptions must be canceled in accordance with the Purchase Options Cancellation Policy.
Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, governing law, and accrued payment obligations.
Section 21 — Disclaimer of Warranties
Information made available through the Services is provided for general informational purposes. Although we make reasonable efforts to provide accurate information, we do not warrant that all content will be complete, current, or error-free.
Except for commitments expressly stated in these Terms, our published policies, or applicable law, and to the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” without representations, warranties, or conditions of any kind, whether express, implied, or statutory, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
We do not guarantee that the Services will always be uninterrupted, timely, secure, or error-free. Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.
Nothing in this section limits our express obligations under the 30-Day Refund Policy or any warranty or consumer right that cannot legally be excluded.
Section 22 — Limitation of Liability
To the fullest extent permitted by law, Harmonex and its affiliates, officers, directors, employees, agents, contractors, service providers, and licensors, and Shopify and its affiliates, will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost savings, lost data, loss of goodwill, or replacement costs arising from or relating to the Services, these Terms, or products purchased through the Services, regardless of the legal theory and even if advised that such damages were possible.
To the fullest extent permitted by law, Harmonex’s total aggregate liability arising from or relating to a claim will not exceed the greater of: (a) the amount you paid to Harmonex for the product or order giving rise to the claim; or (b) one hundred U.S. dollars (US $100).
These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, or gross negligence, or liability for death or personal injury where exclusion is prohibited by law. Some jurisdictions do not permit certain limitations, so all or part of this section may not apply to you.
Section 23 — Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Harmonex, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from:

Your material breach of these Terms or a policy incorporated into them;

Your unlawful or unauthorized use of the Services;

Your violation of applicable law or another person’s rights; or
-
Feedback or other content that you submit.
We will provide reasonable notice of an indemnifiable claim. A delay in notice will relieve you of your obligations only to the extent you are materially prejudiced. We may control the defense and settlement of the claim at your expense, but we will not agree to a settlement that imposes non-monetary obligations on you without your consent, which may not be unreasonably withheld. You agree to provide reasonable cooperation in the defense.
This section does not apply where prohibited by applicable consumer law.
Section 24 — Events Outside Our Control
Harmonex is not responsible for a delay or failure to perform caused by events outside our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, labor disputes, governmental action, supply-chain disruption, carrier interruption, utility failure, internet disruption, or failure of a third-party service provider.
This section does not excuse obligations that applicable law does not permit us to exclude, including issuing a refund when legally required.
Section 25 — Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Section 26 — Waiver and Entire Agreement
Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.
These Terms and the policies and rules incorporated by reference constitute the entire agreement between you and Harmonex concerning the Services and supersede prior or contemporaneous communications and proposals concerning the same subject matter.
Any ambiguity will not be interpreted against a party solely because that party drafted the language.
Section 27 — Assignment
You may not assign, transfer, or delegate these Terms or your rights or obligations under them without our prior written consent. Any unauthorized attempt is void.
We may assign or transfer these Terms and our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, financing, or other business transaction, or as otherwise permitted by law.
Section 28 — Governing Law and Venue
These Terms and any dispute arising from or relating to the Services or a purchase from Harmonex will be governed by the laws of the State of Connecticut, without regard to conflict-of-laws principles.
Except where applicable consumer law permits or requires otherwise, you and Harmonex consent to the exclusive jurisdiction and venue of the state courts located in Hartford County, Connecticut, and the federal courts of the United States District Court for the District of Connecticut.
Nothing in this section deprives a consumer of protections or rights that cannot be waived under the law of the consumer’s place of residence.
Section 29 — Changes to These Terms
You may review the current version of these Terms on this page at any time.
We may update these Terms by posting a revised version through the Services. If a change is material, we will provide notice when required by applicable law. Changes will become effective on the date stated in the revised Terms or notice.
Changes will not retroactively alter an order already accepted unless required by law or agreed by you. Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms.

Section titles and headings are included for convenience only and do not limit or affect the interpretation of these Terms.
